These Terms of Service ("Terms") govern your access to and use of the UseTracd.com deadline-tracking and checklist software (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
UseTracd.com is not a law firm and does not provide legal advice. Nothing in the Service constitutes legal advice, and use of the Service does not create an attorney-client relationship.
UseTracd.com is not a licensed transaction coordination service and does not act as your transaction coordinator. The Service is software that helps you, a licensed real estate professional, organize and track your own transaction files — it does not perform transaction coordination duties on your behalf and does not assume any of your professional responsibilities.
UseTracd.com and its personnel are not licensed real estate agents or brokers, and the Service does not provide real estate brokerage services. You are solely responsible for complying with all licensing, fiduciary, disclosure, and other obligations that apply to you as a real estate professional in your jurisdiction.
The Service is intended for use by licensed real estate agents and other real estate professionals acting in that capacity. You must provide accurate account information and are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
The Service allows you to upload real estate transaction documents, automatically extract deal terms using an AI-based process, generate a task checklist with computed deadlines, receive reminders, and share a read-only status link with your Clients. Deadlines and extracted terms are generated automatically and are estimates based on the information provided — you are solely responsible for independently verifying all dates, deadlines, and contract terms against the actual signed agreement. UseTracd.com is not responsible for missed deadlines, extraction errors, or any consequence of relying on the Service without independent verification.
You represent that you have the right to share information about your Clients (buyers, sellers, and other transaction parties) with us through the Service, and that doing so complies with your professional and legal obligations, including any applicable confidentiality or data protection requirements. You are responsible for the accuracy of the information you upload and for controlling who you share client portal links with.
New accounts include one free transaction, with no payment method required. Continued use requires a paid subscription plan, as described on the Billing page at the time of purchase. Each plan includes a set number of transactions per billing cycle; creating a transaction beyond that number requires a one-time additional payment at the price shown at the time. Subscriptions renew automatically until canceled. You can cancel or change your plan at any time from the Billing page; cancellation takes effect at the end of the then-current billing period unless otherwise stated, and you retain access through the end of that period. Fees are processed by Stripe and are non-refundable except where required by law.

Authorized UseTracd.com personnel may access your account and transaction data to provide customer support, investigate reported issues, or maintain the security and integrity of the Service, as described in our Privacy Policy.
The Service, including its software, design, and underlying technology, is owned by UseTracd.com and is protected by intellectual property laws. You retain ownership of the content and documents you upload. You grant us a limited license to store, process, and transmit that content solely as necessary to provide the Service to you.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-extracted data or computed deadlines will be accurate or complete.
To the fullest extent permitted by law, UseTracd.com shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from your use of the Service — including any missed deadline, extraction error, or transaction outcome. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve months preceding the claim.
You may stop using the Service and delete your account at any time from Settings. We may suspend or terminate your access if you violate these Terms or misuse the Service. Upon termination, your right to use the Service ends immediately; data deletion is handled as described in our Privacy Policy.
We may update these Terms from time to time. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Delaware, without regard to conflict-of-law principles.
